Dash cams for cars are becoming more and more popular in Germany, but the small cameras are still not really legal to this day. In this practical tip, we will tell you what is allowed and what is not.
Dashcams in the car: legal or illegal?
First, you should ask yourself why you want to use a dash cam in your car. Because for some purposes it is not allowed to use dash cams.
- According to the data protection law, it is not allowed to film public transport continuously. However, you will not be threatened with an ad by using the Dashcam.
- A relevant violation of the data protection law only arises when you publish the recordings on the Internet. In theory, you can sue people or owners of vehicles if you do not make them unrecognizable.
- According to data protection experts, there is nothing to be said against making a small film clip during a vacation trip for personal or tourist reasons.
- In other countries such as Austria, installing and carrying a dash cam in the car is expressly illegal. In the event of a violation, fines may arise.
- Since May 15, 2018, there has finally been clarity in Germany about the use of dashcam recordings in court. Despite violating the data protection law, the recordings are admissible as evidence.
- The admissibility is always at the discretion of the judge. In most cases, the interest in investigating the accident should outweigh the interest in protecting the data protection law.
