DSL special termination right: In the event of malfunctions and slow connection
In theory, if you would like to make use of your special right of termination in the event of permanent DSL disruptions. We will show you what it looks like in practice.
DSL too slow: is there a special right of termination?
- Slow Internet is a big problem in many German households. However, there is no general right to terminate the contract in the event of disruptions or a slow Internet connection.
- Officially, the providers only promise "up to 50 Mbit / s". The speed at which you surf can therefore vary greatly from the respective offer. Nevertheless, there are options for a special termination.
Internet too slow or disturbed: the burden of proof
- If your internet keeps failing, you should write down the downtimes for a few days and weeks. Call the free service hotline whenever possible so that your DSL provider also notes the malfunctions.
- If your internet is too slow, you should also call at least once. In addition, you should document the speeds over several days and weeks.
- You can use a test such as the CHIP speed test. If possible, switch off all WLAN devices in the house and connect your PC or laptop to the router using a LAN cable. This is the only way to get a meaningful result.
Special right of termination in the event of slow or disrupted Internet
- Since there is no general right to terminate the contract, you can rely on §626 BGB. Termination is possible if the DSL connection is not reasonable.
- When in doubt, the courts will decide when this is really the case. In the past, there have already been judgments in which a special termination was legal from half the promised speed. However, some judges also decided that the actual speed must be less than a third.
- It is best to write to your DSL provider with your documentation and §626 BGB. If he does not give in, only a lawyer can help.
