Guarantee vs. Warranty: "Warranty" - what is behind it?
In principle, an article must be free of any defects when it is sold (section 433 (1) sentence 2 BGB). If the product is defective or even defective, the buyer is entitled to a purchase price reimbursement or a defect-free device (§ 437 BGB). The details:
- The warranty rights can be found in § 437 BGB. You can only assert the following rights against the seller: repair or new delivery, purchase price reduction and compensation.
- The usual limitation period is two years (Section 438 (1) No. 3 BGB). For you as a buyer, this means that you can list the defects within two years of the purchase that you already had when you made the purchase.
- According to § 474 BGB, the seller must prove within the first six months that he has not delivered a defective device. This is usually very difficult for the seller.
- Only if the defect occurs later than six months after the purchase do you have to prove that you did not cause the defect yourself, but received a faulty product. This is usually difficult to prove for the buyer.

Guarantee and warranty are often confused
The two terms "guarantee" and "guarantee" are often mistakenly interwoven.
- A guarantee is a voluntary insurance of the dealer against the buyer.
- The guarantee always comes alongside the guarantee claims and can never limit them.
- With the guarantee, the dealer usually promises the functionality of the product or individual parts for a certain period of time.
- Unlike the warranty rights, it does not matter whether the product is defective before or after purchase. Finally, functionality is guaranteed here for a certain period of time.
