A temporary lease is only possible under certain circumstances. As a tenant and also as a landlord, you have to pay attention to a few things, otherwise the rental contract is automatically unlimited. In some cases, such a contract can make sense.

There is a lot to consider with a temporary rental contract, since it is not a conventional rental contract.
- There is no time limit for a temporary lease.
- It is not possible to simply cancel the lease. You need special reasons for this. Likewise, the landlord cannot simply give you notice.
- The lease ends automatically after the time has expired.
- For this reason, you should think carefully before signing the lease or not. As a rule, they are bound to the duration stipulated in the contract. If in doubt, a very short or very long duration is not suitable for you.
- The landlord may only set up such a rental agreement if given specific reasons. These include the landlord's own needs, major structural repairs after the rental period has expired and leasing to service providers such as the caretaker.
- As a tenant, check whether the reasons given are final . If they are not, then your contract is unlimited .
- Inquire about four months in advance whether the tenancy actually ends or extends at that time .
- If the reason for the limitation is no longer current or occurs later, the period can be extended or the lease becomes permanent .
Landlord: You have to pay attention to this
As a landlord, you have to consider a few things in a limited contract so that it is also effective. Otherwise it is automatically perpetual.
- As a landlord, you must be able to provide certain reasons . Otherwise the contract is invalid or unlimited .
- You must state the reason for the limitation at the latest in the rental agreement . Of course you can also do this beforehand.
- If you only inform the tenant of the time limit after the rental contract has been concluded, this is ineffective .
- Reasons that are justified : The landlord registers his own needs for himself or his relatives, the house is to be demolished or converted, or the apartment is made available to a service provider such as the caretaker.
- You must formulate the reason in detail with the end date of the rental contract.
- It is not possible to change the reason afterwards.
