Rental agreement: termination by the landlord - that's what matters
It is not easy to terminate a lease as a landlord. The following points must be considered:
- Notice period: The notice period depends on the length of the existing tenancy. The term is three months for a contract of up to five years. If the tenancy lasts between five and eight years, the period increases to six months, and over eight years to nine months.
- Reason for termination: There are only three reasons that entitle a landlord to terminate: A breach of contract - for example, if the tenant does not pay -, personal use and if the current rental prevents the landlord from using the property appropriately economically.
- Notice of termination must always be given in writing and must state a justifiable reason for termination.
- In order to meet the deadline, the tenant must have received the notice of cancellation by the 3rd of the month. Otherwise, the period begins in the following month.
Legal security through submission of subscription alarm
As a landlord, you have to consider so many things when you cancel that it's worth using a template.
- The subscription template from Aboalarm has been checked by a lawyer. So you can be sure that all important elements are in place and formulated in a legally secure manner.
- However, you must enter the necessary information yourself. In addition to your contact details, this also includes the name and address of the tenant in the address field.
- In the letter, you must complete the information on the rental property and enter the cancellation date.
- The template contains all possible reasons for terminating the tenancy. Select the reason that applies to you and delete the remaining reasons.
- In the following section you indicate the date on which the apartment must be vacated and also the handover date.
- You can now forward the cancellation to the tenant via Aboalarm. Your signature will then be generated automatically and you will receive a confirmation of termination immediately afterwards. This service costs you 3.49 euros.
- Alternatively, download the completed notice of termination onto your computer and print it out. Sign the cancellation and send it to your tenant as a registered letter.
