The Waldorf Frommer law firm is currently sending warnings for illegal streaming at Popcorn Time. If you have received such a warning, there are several strategies how you can react to it.
Popcorn time warning: is the use illegal?
Popcorn Time is software that allows you to stream films and series via PC software or Android app. Speaking to CHIP, media lawyer Christian Solmecke said: "Anyone who uses Popcorn Time and cuevana.tv in Germany is clearly acting illegally".
- The problem with the software is that users not only stream the films and series, but at the same time distribute illegal copies via the BitTorrent network.
- This turns the supposed streamer into a file sharer, that is, the simple downloader into an illegal distribution list. The IP addresses of the users can be traced back in the BitTorrent network.
- The use of the software is therefore undoubtedly illegal, even if you as a user knew nothing about it.

Warning for popcorn time - you can do that
- You will be asked to submit a cease and desist order and pay a sum of damage in the amount of several hundred euros.
- Instead of submitting the injunction, you can fill out a modified injunction. A modified cease and desist declaration (in contrast to the one pre-formulated by the Abmahn lawyer) is not an admission of guilt, but only promises to refrain from this legal violation in the future. - You can then decide whether you want to pay the sum or not. If you refuse payment for the time being, you should object to incoming payment orders or collection requests.
- If you ignore the warning and do not submit a modified injunction, there is a risk that the warning will obtain an injunction from the court. With such a “quick decision” by the court, the costs can quickly increase to a few thousand euros, depending on the amount in dispute.
Submit modified injunction - the right solution?
Sign the letter of cease and desist sent, at the same time make a concession of debt, as well as an acknowledgment of the lawyer's fees and compensation.
- In order to satisfy the warning party, a so-called modified declaration of omission (mod.UE) is usually sufficient. You promise to refrain from this legal violation in the future.

- Send the modified injunction only by registered letter with return receipt. So you can prove the entrance later.
