Resell ticket - is it legal?
If, for example, you bought a ticket for a concert, the question arises whether reselling is legal if you are unable to keep the appointment. Since this problem has probably already occurred in most cases in this or a similar form, we have investigated the question once.
So you are on the safe side when selling tickets
Basically, when reselling tickets, a legal distinction is made between commercial and private sales. If you buy tickets more often and then sell them profitably, you will quickly find yourself in the commercial area. Then other laws apply to you than to the private seller. In this practical tip, however, we only assume that the sale is purely private.
- First of all, a private ticket sale can be said very clearly that it is legal, as the Federal Court of Justice stated in a judgment from 2008 (BGH, 09/11/2008 - I ZR 74/06). It is aslo your right to resell the legally acquired concert ticket or football ticket, for example via eBay.
- As a rule, the organizers try to prevent resale through their terms and conditions. However, this is not relevant for you as a pure private seller.
- If you get more money for the ticket than you have invested yourself, this is also not prohibited by law. Perhaps this relieves a little the pain of not being able to take part in the event.
- The situation is somewhat different with the so-called personalized admission tickets. In this case, the organizer actually only has to grant admission to the person whose name the ticket was issued for.
- This means that in the event of an incident, you must contact the organizer to clarify whether the ticket can possibly be rewritten with a different name.
