With a precautionary power of attorney, you determine who handles your private and financial affairs if you are unable to do so.
- In principle, you do not have to have a proxy notarized. However, it can then be slightly questioned and thus become ineffective.
- Allow the notary to advise you and certify the power of attorney, from a legal point of view you have clarity, similar to when filing a will. The notary not only checks your identity, but also determines your legal capacity.
- How much the notary may charge for the certification of a pension proxy is regulated and depends on the so-called business value.
- In the case of a power of attorney, the goodwill amounts to half of their total assets. If you still have debts, you cannot offset them.
- For example, if your assets amount to 100, 000 euros, a business value of 50, 000 euros is used. In this case, notary fees of 165 euros are incurred for the power of attorney.
- With a business value of 25, 000 euros, the fee is reduced to 115 euros. In contrast, the notary fees with a business value of 250, 000 euros amount to 535 euros.
- The certification fee is capped at a maximum of 1, 735 euros. Even if you are a multi-millionaire, there are no higher notary fees.
