You should always observe copyright law on YouTube. This applies primarily to YouTubers who upload videos themselves. But there are also rules for users.

Basically, you can only upload videos that you have produced yourself. Rather, it means that you are responsible for all content and need the appropriate rights. In the YouTube Creator Academy you can see how you can protect yourself as a YouTuber or rights holder.
- You must have the necessary rights to any music or other elements of the video. So you need a so-called permission to use the content.
- If there are people in your videos, they must agree to the publication.
- For security, you should have this declaration of consent given in writing so that you can present it in the event of a lawsuit.
- For example, if people only walk through the picture by accident, you do not need a declaration of consent.
- This also applies to advertising in the background or advertising that unconsciously appears in the video.
- Images protected by copyright, for example in the background, do not have to be made unrecognizable.
- But! Just because you have filmed with your smartphone, you are not automatically the rights holder. If you make a video of a concert, the artist or the label or the publisher can be the rights holder of the material.
- Cover songs can also be legally protected. So you also have to ask for the permission of the copyright holder when playing songs.
- The so-called fair use rule also applies to YouTube. This states that copyrighted content can also be used in certain circumstances without obtaining the rights of the author. This applies, among other things, to reporting or teaching, and scenes can also be used for artistic purposes.

Viewing copyrighted material on YouTube has not yet been clearly clarified. Because when watching the video is only cached and not fully downloaded.
- You are thus in a legal gray area, since only the complete download of copyrighted material is punishable by law.
- However, downloading YouTube videos is legal unless the videos are copyrighted.
- The re-use of the downloaded videos is then subject to other rules.
