- According to a judgment of the Federal Court of Justice, anyone who has an open WLAN is no longer liable for the abuse that is carried out by neighbors or others via the WLAN connection. The fellow users only have to be named and proven who caused the damage. As a WLAN operator, you are therefore not liable for others.
- If your neighbor cracks your WiFi password despite secure encryption, you are also not liable for potential misconduct by other people via your WiFi connection - provided you can prove secure encryption. A password with at least 20 characters is recommended by the Federal Office for Information Security. There is also WPA2 encryption.
- In the case of a WiFi sharing in the form of a small contract, secure yourself legally with all roommates in a certain way, although the final judgment can vary from court to court.
- If you share the WiFi with other people for a fee, you will not be punished. However, your provider may terminate you if they do not agree.
